Bail vs. Own Recognizance Release — What Is the Difference?

Own recognizance release means no bail required. But most defendants do not qualify. Here is how judges decide and what it means for your case.

What Is Own Recognizance Release?

Own recognizance release (OR or ROR) means the defendant is released from custody without posting bail. Instead of money, the defendant signs a written promise to appear at all future court dates. There is no premium to pay, no co-signer required, and no bond.

Who Qualifies for OR Release?

OR release is not available to everyone. The judge decides at arraignment based on severity of charges, criminal history, ties to the community, flight risk, and whether the defendant poses a danger to others. Minor misdemeanors are far more likely to result in OR release than felonies or violent crimes.

What Happens If OR Is Denied?

If the judge denies OR release, bail is set. The defendant must post the full bail amount in cash or use a licensed bail bondsman who posts the bond for a premium (with Chad, usually 6% to 8%). This is where Chad Conley Bail Bonds steps in — available 24/7 to post bail the same day.

Bail vs. OR: Which Is More Common?

The majority of felony defendants in California are required to post bail. OR release is more common for misdemeanors, first-time offenders, and defendants with strong community ties. If you are unsure which applies to your situation, call us and we will walk you through it.

After the bond

The bond is just the start. Chad stays with you.

Price matters. But a lot of bail companies are salespeople sitting at a desk. They sell you the bond on the phone that night, and after that you get passed from department to department. With Chad, the same person who writes your bond is the one who picks up when something comes up.

A real example (name changed)

Fred missed his court date, and he still owed a balance. Chad helped him anyway. He stayed up late with him and put together the paperwork to ask the court to reinstate his bond. On the way to court, Fred's car broke down and got towed, with the paperwork inside. So Chad did it all over again, and Fred came by the office to pick up a new set.

You could roll the dice on whoever quotes the cheapest bond on the phone. Or you could have a bondsman who picks up when it really matters.
