Health & Safety Code 11364 — Drug Paraphernalia

HSC 11364 Bail Bonds — Drug Paraphernalia Possession

One of the most common misdemeanor add-on charges in Southern California drug arrests. Chad Conley posts bail 24/7.

Typical Bail:$5,000 – $10,000

What Is Health & Safety Code 11364?

HSC 11364 makes it a misdemeanor to possess any device, contrivance, instrument, or paraphernalia intended for unlawfully injecting or smoking a controlled substance. This includes pipes, syringes, spoons, and other items associated with drug use. It is almost always charged as an add-on to HSC 11377 (meth possession), HSC 11350 (narcotics possession), or HSC 11550 (under the influence). Paraphernalia charges are misdemeanors and carry relatively low bail, but they create a criminal record and can affect employment and professional licenses.

Elements of the Charge

  • You possessed a device, contrivance, instrument, or paraphernalia
  • The item was intended for unlawfully injecting or smoking a controlled substance
  • You knew the item was paraphernalia
  • No controlled substance needs to be found — the paraphernalia alone is sufficient

Typical Bail Amounts for HSC 11364

Charge / ScenarioTypical Bail
Standalone misdemeanor, first offense$5,000
Add-on to drug possession charge$5,000–$10,000 (stacked)
Add-on to HSC 11550 (under the influence)$10,000 (stacked)
Prior drug convictions$10,000

Bail is set by county schedule. When charged alongside other offenses, bail is stacked — each charge adds to the total.

Most of Chad's bonds are written at 6%, 7% or 8%. Smaller bonds, under $20,000, can be up to 10% because of posting fees. On a $5,000 bail, your cost is $500. Chad offers payment plans.

What the Family Needs to Know

HSC 11364 is almost always an add-on charge filed alongside possession or under-the-influence charges. Bail is typically low, making it one of the most affordable bonds Chad posts. Getting your loved one out quickly gives them time to work with an attorney and explore diversion or treatment options.

Cosigning an HSC 11364 Bond

Drug paraphernalia bail is generally low. Here's what cosigning means:

What Cosigning Means

  • You guarantee the defendant appears at all court dates
  • If they fail to appear, you are responsible for the full bail amount
  • Total bail may be higher if other charges are filed alongside HSC 11364
  • The premium is non-refundable once the defendant is released

After the bond

The bond is just the start. Chad stays with you.

Price matters. But a lot of bail companies are salespeople sitting at a desk. They sell you the bond on the phone that night, and after that you get passed from department to department. With Chad, the same person who writes your bond is the one who picks up when something comes up.

A real example (name changed)

Fred missed his court date, and he still owed a balance. Chad helped him anyway. He stayed up late with him and put together the paperwork to ask the court to reinstate his bond. On the way to court, Fred's car broke down and got towed, with the paperwork inside. So Chad did it all over again, and Fred came by the office to pick up a new set.

You could roll the dice on whoever quotes the cheapest bond on the phone. Or you could have a bondsman who picks up when it really matters.
